SC denies stay on EC’s decision but vacates election code in AP

The Supreme Court on Tuesday refused to interfere in the decision of the Andhra Pradesh Election Commission to postpone the local body elections.

However, it ordered to vacate the election code since the elections have already been postponed for 6 weeks and advised the EC to finalise the fresh dates only after a dialogue with the state government for holding fresh elections.

The decision has come in response to the writ petition filed by the State Government opposing the EC’s decision to postpone the elections. The 3-member bench comprising CJI Justice Bobde, Justice BR Gawai, and Justice Suryakanth while refusing to react to the argument of additional solicitor general that there is a political interest involved behind EC’s decision, however, asked the counsel for the EC how could it continue the code when there is no election in vogue and ordered to vacate it with immediate effect to enable the state government to carry out with its social welfare measures.
