TSBPASS Bill passed in Assembly

Minister for Municipal Administration KT Rama Rao is presenting the TSBPASS Bill in the assembly.

The Telangana State Building Permissions and Self Certification Systems Bill 2020 (TSBPASS) has been passed by the state assembly today. The bill aims to bring in a more transparent process and assures service within timelines with minimal official intervention. 

Introducing the bill in the state assembly, the minister for municipal administration and urban development KT Rama Rao said that this TSBPASS is aimed at bringing reforms in the Municipal administration in according fast track building approval with minimal documentation and to ensure a transparent delivery of citizen services in a speedy manner. 

He further stated that it is a first of its kind and is a fully automated, completely transparent and citizen-friendly system, under which the system permissions will be issued in a time-bound manner without any delay.  It’s a single-window approval  for building permits without any human interface

Referring to the role of town planning teams, the minister said that it will be minimized with regard to the building permissions. They will be henceforth deployed to focus on District Urban Master planning, Road Widening and Road development plans, Municipal Waste Management Plans, GIS-based Planning for Civic Infrastructure and Other Futuristic Planning related works.

KTR also informed the house that in the present DPMS System for building, layout permissions (launched in 2014), irrespective of plot size, files were being processed and applicants had to wait for a couple of months with occasional complaints on the officials. Though DPMS was a significant effort in moving from paper-based to online digital service delivery, further improvements were felt to ease the process of issuing building and layout permissions.  

Explaining the salient features of the bill, the minister said that post verification will be done in 21 days during which the applicant shall not commence construction activity. Post verification process will be monitored by the District level TS-bPASS Committee chaired by District Collector. Action will be taken on officials for deemed clearances after 21 days. Revoke of Certificate of Registration obtained through online registration or Self-certification online approvals will be done if any misrepresentations or violations found during post verification, he added. 

He stated that scrutiny and processing will be done by cross-department teams. Only error-free DCR drawings are accepted by the system to avoid shortfalls. Artificial Intelligence-driven support system via omnichannel (Social, Email, Chat, Whatsapp, Call centre) including bridge call system. Accessible via Web, Mobile, MeeSeva, CSCs in ULBs. 

A regulatory mechanism has been set up which will be monitored by State Level TS-bPASS Committee chaired by the Principal Secretary, MA&UD.  Similarly in the districts, it is governed by District level TS-bPASS Committee chaired by District Collector to monitor the progress of the applications and deemed approval.  A State Level Chasing Cell for departmental follow-ups has been set up.  State Level Central Support System to ensure that every grievance or issue reported is attended.  The applicant will be updated via SMS at every stage.

KTR further clarified that above 600 Sq. yards residential, all non-residential buildings & Layout Permissions (Tentative and Final), Occupancy Certificate, permissions will be accorded within 21 days. Otherwise, deemed approval will be issued on the 22nd Day.

Reacting on the bill, Congress floor leader Bhatti Vikaramarka sought to recheck the provision “Deemed to be issued the Self-Certification” as it doesn’t carry any value outside be either a bank or in another govt institution. He also pointed out another anomaly which stated that if the permission is not given within 21 days the application was deemed approved and later it was found that the information furnished by the applicant was wrong, the permission can be cancelled.

“Where is the question of finding the application faulty within 21 days as the fault lies with us since we have not taken the application seriously. And in case of self-certification based on which a real estate person will transact business and in case of any dispute arises RERA will not acknowledge this permission and he will land in trouble. Hence I suggest finalising the applications in the same meeting in one go by passing a due resolution to this effect so that the permissions are given in a very transparent manner”, said Bhatti Vikramarka.
